Another victory for LFC/RBS in court

Mr Justice Floyd today ruled that “This case has nothing to do with Texas.” and gave Tom Hicks and George Gillett until 4PM (UK time) tomorrow to comply with the court order and drop the injunction.

This means that once that is dropped the sale of LFC can go through with NESV becoming the new owners.

After everything we have been through I don’t advise we celebrate yet.

Tom Hicks might try something else.

  1. I’m confused as to why the board is refusing to even consider peter lim’s offer? the offer is clearer superior to NESV’s. I think that this is bias and doesn’t seem fair to peter lim and the liverpool fans.

  3. in response to KTBFA…im sure the board assessed everything in the due diligence, the mistakes made last time the club changed hands would have been a constant reminder of the need to get it right this time round. as MB said ‘keep the faith’. This decision is probably the defining moments in MB, CP and IA business careers. NESV have a proven track record and the fact that Lim has upped his offer shouldnt have a bearing on who is the most suited custodians. I just hope these two muppets havent got anything else up their sleeves to further delay. Another battle won lets hope thats the war! YNWA

  4. Lims offer better than NESV? are you dense or what?. J W Henry is a $billionaire with 16 other multi millionaires in the consortium, Lim offers £40m for player, so what. NESV have built 2 stadiums and re-built Fenway Park, look at their success and relationship with their fans.

  5. Talksport saying H+G could be arrested in the uk, If before 1600hrs tomorrow they haven’t stopped their legal efforts. That means they won’t come back to the UK, the legal system in the US is a joke!!!!

First i heard that Lims is a man u fan and he has man u bars so no matter what money he has im sure we Liverpool fans don’t want him and as has been said already it is not about who has the most money it is who is the best for Liverpool now im sure non of will be happy till we see with our own eyes what the new owner has in store for us but we will have to hope that the Liverpool have found the right people to take us forward

    Now for my main point, have i missed something or have i got it right???
    Hick injunction failed and he has to lift it by tomorrow 4pm
    the the club can be soled of cores un less the tit head comes up with another lode or s**t
    the the club would not go in to administration and not get -9 points???

    I just ask cos on bbc they said that Hicks had till the 15th to pay the lone if not then the club would be owned by then bank who would find some one to buy the club and then we would not resive the -9 points if a if this happens after the 15 then we would go in to administration?

  7. Apparently they can be held in contempt of court if they fail to withdraw the injunction. This means that Hicks could go to prison if he ever returns to the UK. Could be he extradited from the US or am I dreaming?

    Also, a quote sent into the Guardian blog that Antoine linked to earlier indicates that the Texas court has no jurisdiction by its own constitution:

    “District courts are courts of general jurisdiction. A constitutional amendment adopted effective in November 1985 amends Article V, Section 8 of the Texas Constitution, in pertinent part, as follows:

    District Court jurisdiction consists of exclusive, appellate, and original jurisdiction of all actions, proceedings, and remedies, except in cases where exclusive, appellate, or original jurisdiction may be conferred by this Constitution or other law on some other court, tribunal, or administrative body.

    This provision, while it extends a district court’s potential jurisdiction to “all actions,” also makes such jurisdiction relative in that the court’s jurisdiction excludes any matters in which exclusive, appellate, or original jurisdiction is conferred by law upon some other court. For this reason, while one can speak of the “general” jurisdiction of a district court, the actual jurisdiction of any specific court will always be limited by the constitutional or statutory provisions that confer exclusive, original, or appellate jurisdiction on other courts serving the same county or counties.”

    The Texas court may have been able to handle the case, but can’t because proceedings are already underway in London. Done and dusted, I hope.

  10. Scratch that, a lawyer commented that only deals on counties within Texas. Still, the fact that a court in Texas doesn’t have jurisdiction over other COUNTIES in Texas makes it seem silly they want jurisdiction over other COUNTRIES!

  12. I find it pleasing that people form my home state, Oklahoma, and Liverpool have something in common. We both hate Texas as of late. My word is coming together.

  13. Got a very bad feeling this whole Texan court sham is a delaying tactic to buy time for mill financial to get the funds together to lend hicks. Really hope I’m wrong, from what I’ve read mill have a similar track record as the two clowns when it comes to sports ventures.
